A NURSE has been jailed for nine years after raping a 17-year-old girl at Oxford’s John Radcliffe Hospital and sexually assaulting another patient in her bed.
Oliver Balicao, 37, was convicted of raping the teenager in a side room in the accident and emergency department at the John Radcliffe Hospital in Headington and sexually assaulting a 22-year-old student.
Judge Stephen John was told yesterday that Philippines-born Balicao was working as a nurse at the JR when he raped the teenager in October 2004.
At the time, her mother and the girl’s boyfriend did not believe her rape allegations because she had experienced hallucinations during her admission for a drug overdose, said Allan Mainds, prosecuting.
However, three years ago the victim went to the police after seeing British citizen Balicao’s photograph in the Oxford Mail when he admitted having sex with a 16-year-old patient in a toilet.
In that case he was acquitted of rape but sentenced to 16 months in jail for abusing his position of trust as a nurse, after a trial at Oxford Crown Court in December 2007.
Father-of-two Balicao was yesterday also sentenced for an indecent assault on a student who was being treated for blood clots on her lungs.
Mr Mainds told Reading Crown Court that Balicao touched the woman’s arm and forced a kiss on her mouth in October 2002.
She also decided to come forward and speak to the police following his 2007 conviction.
Brian Stalk, defending, said Balicao was “crushed” by the jury’s guilty majority verdict a month ago.
He said: “If there was ever a lesson to be learned, he has learned it and he will never make the same mistake again.”
The judge told Balicao that he had shown no remorse in his continual denial of the charges against him.
He said: “The rape of the 17-year-old girl was premeditated. You took her to another room and used a condom.
“The 22-year-old woman was a student in the UK for four weeks and another patient in your care. Again you abused your position of trust.
“It appears your past offending caught up with you when both saw news reports of your conviction in 2007.
“The minimum sentence for rape in a position of trust is eight years.
“Taking into account the 25 days you have already served on remand, you will be sentenced to 18 months for the indecent assault.
“You will serve nine years in total.”
Balicao, of Lerwick Court, Bicester, was banned from working with children under the age of 16 and was placed on the Sex Offenders’ Register following his conviction in 2007.
Speaking after the hearing, Elaine Strachan-Hall, the chief nurse of Oxford Radcliffe Hospitals NHS Trust, said: “His behaviour was unacceptable for any nurse in any circumstances.
“Oliver Balicao is no longer able to work as a nurse, because his name has been removed from the Register by the Nursing and Midwifery Council.”
