A developer is pursuing its battle to build on a site in the north of Oxford.
Last month, Oxford City Council threw out Berkeley Homes (Oxford) Ltd's application to redevelop the former Unipart site, in Woodstock Road, because the company hadn't included affordable housing in the plans.
That was the second time the firm had applied to build on the site, east of the canal. An application made 18 months ago was held in abeyance while new guidelines were drawn up.
Now the firm is appealing as no decision was made on the first application.
It hopes to build 50,000sq ft of business premises and an unspecified number of homes. Councillors want half of the homes to be affordable.
Planning officer Murray Hancock said: "They are appealing against non-determination."
Berkeley Homes said it did not wish to comment. An inquiry will be held on November 6 at Oxford's Town Hall.
