A soldier who is going through a divorce was bound over to keep the peace after a row with his wife.
The Crown Prosecution Service withdrew a charge against Alan Bain of assaulting Joanna Bain in Abingdon on December 30 last year.
Helen Waite, prosecuting, told magistrates Mrs Bain suffered bruising, scratches and a cut foot during a row at their home after the couple had been drinking at Strattons Night Club, in Abingdon.
Miss Waite said: "Too much alcohol had been taken on board by both parties."
At Didcot Magistrates' Court, Bain, 28, of Spey Road, Abingdon, was bound over in the sum of £200 to keep the peace for six months, especially towards Mrs Bain.
Daniel Eddershaw, defending, told the court: "It was an unfortunate incident arising out of the breakdown of their marriage."
The couple, who are separated, are now living apart and going through divorce proceedings.
