Cherwell District Council is taking action against a retirement home developer for failing to repair a boundary wall.
At a south area planning meeting, councillors agreed to serve a formal notice on builder McCarthy and Stone requiring it to raise the wall.
McCarthy and Stone, which builds assisted living retirement apartments, says it is now considering its position.
Home-owner David North, of Priory Close, asked the council to intervene after the company allegedly went back on a verbal promise and refused to rebuild a dry stone wall.
Planning officers say it is not a cut and dried case.
In the original plans, the council interpreted markings to mean the wall would be repaired to its original height of about six feet. But McCarthy and Stone claims it agreed to keep the wall, which borders the Bicester conservation area, at its current height.
