A teenager accused of raping a woman at a Halloween party told a jury they had indulged in a night of mutual passion.

The 17-year-old, who cannot be named for legal reasons, is alleged to have raped the woman as she lay passed out on a bench at the party in Aston Street, east Oxford.

But the defendant, who originates from Somalia but claimed asylum in England when his parents were killed, claimed that sex between them was consensual and took place while other couples were having sex around them.

He said it was only the next morning when they woke up and again had sex, that she got angry and began hitting and punching him.

Eloise Marshall, prosecuting, said the victim woke up to find the defendant having sex with her and fought him off, before going to the police later that day.

Dc Stewart Codling, of Thames Valley Police, told the court a swab was taken from the victim, and semen was found and sent for DNA testing.

The victim had been unable to describe her attacker, but results indicated the chances were 367 to one it came from a black man.

There were only two black-skinned men at the party, and Dc Codling said the other was quickly ruled out. The defendant was arrested in July this year.

The defendant told the jury that he had been chatting and dancing with the alleged victim in the kitchen, before she led him downstairs to the basement. He described the scene there as an "orgy" with five or six couples having sex. He lost his initial shyness and they had sex with each other.

The jury was due to retire today to consider their verdict.
