A JURY has been dismissed in a death by dangerous driving trial after the defendant was hospitalised.

Lorry driver Barry Archer, 43, was on trial at Oxford Crown Court charged with causing the death of Tom Glancy, 64, by dangerous driving.

The incident occurred on July 16, 2020, on the A420 near Pusey.

Archer denied the offence but has pleaded guilty to an alternative charge of causing death by careless driving.

The Crown Prosecution Service did not accept the alternative charge plea and the trial started on Tuesday last week (July 23).

However, Judge Nigel Daly dismissed the jury a week later on Tuesday (July 30) after the trial was adjourned for several days due to Archer being hospitalised.

Judge Daly told the jury he had become unwell and it was unclear when or if he would be able to attend court again for the proceedings to continue.

The case has now been relisted for a mention next week for a new trial date to be scheduled.

During this trial it was heard that Archer was driving a 2016-plate Mercedes Actros lorry towards Leighton Buzzard and Mr Glancy was driving his Ford Transit milk float in the opposite direction.

It was about 2.45am when Archer entered the opposite lane ‘completely’ and collided with Mr Glancy’s vehicle head-on, causing Mr Glancy’s death.

Archer told the court he was swerving to avoid a deer.
