A Blackpool man caught speeding on the A34 near Botley has been spared a driving ban.

Mark Brooks, 44, convinced magistrates in Wycombe that his family would face ‘exceptional hardship’ if he was banned from driving for six months as a repeat offender who had ‘totted up’ 12 penalty licence points.

Court records noted that, on Brooks’ behalf, it was argued that the defendant was the sole breadwinner for the family, took his stepson to appointments twice a week, and ‘alternative lines of employment in Blackpool [were] not available’ particularly as it was almost the end of the tourist season. He supported his partner, who could not work as a result of an accident.

Brooks, of Warbreck Hill Road, Blackpool, pleaded guilty via post to speeding on the A34 at the Botley Interchange on November 24 last year.

The Vauxhall Vivaro driver was caught doing 66mph on the 50 zone road.

The magistrates imposed four penalty points but did not ban him from driving under ‘totting’ rules. He was fined £307 and must pay £213 in costs and surcharge.
