MANAGERS at a motorway service station on the M40 have lost their final chance to claim £15.5m damages.
Moto Hospitality, which owns part of Cherwell Valley Services, sought compensation from the Department for Transport claiming road layout changes at the Ardley interchange on the M40 made the service station less accessible, convenient and attractive to motorists.
In 2006, the Lands Tribunal ruled Moto was entitled to compensation but the decision was overturned by the Appeal Court in September.
Now the Law Lords have upheld the court's decision and refused the company permission to challenge it in the House of Lords.
