A WOMAN who claims she was raped has told a court she woke up and her alleged attacker was on top of her.

Maximillian Hessel, of Peat Moors, Headington, Oxford, denies one count of rape which he is accused of committing in June last year.

The 22-year-old is alleged to have carried out the crime in the early hours of the morning.

Yesterday Oxford Crown Court heard evidence from his alleged victim – a woman who cannot be named for legal reasons.

She told the court that Hessel was on top of her having sex with her when she woke up.

On the third day of the trial Jeannie Mackie, defending, asked the complainant if she could be wrong about what happened.

Miss Mackie said: “The suggestion I am going to make is that he was more half on top, half on the side of you. Not really on top of you at all.”

The woman said: “He was on top of me.”

During questioning from Sarah Gaunt, prosecuting, the woman said: “I don’t believe he was asleep at all.”
