COUNCILLORS agreed to defer the potential expansion of Campfield House after a last minute recommendation from planning officers.
Cherwell District Council was set to vote on the controversial plans that would have more than doubled the number of detainees at the immigration removal centre.
Planning officers had initially recommended to approve the decision, but now the decision has been deferred until a date yet to be set.
It follows a letter submitted by solicitors Leigh Day on Tuesday morning claiming the report of the planning officer recommending approval was "wrong in law".
